Nahaharap sa “life sentence equivalent to 20 years and one day to 40 years imprisonment” ang mga napatunayang guilty sa enforced disappearance case.
Sinabi ni Cristina Palabay, secretary general ng human rights group na Karapatan, pinag-aaralan ng mga abogado nina Jonila Castro at Jhed Tamano.
Ang posibilidad na sampahan ng kasong paglabag sa Republic Act 10353 o Anti-Enforced Disappearance Act laban sa militar at mga kasapi ng National Task Force to End Local Communist Armed Conflict (NTF-ELCAC) na dumukot sa kanila.
Nabatid kay Palabay na ang Pilipinas lamang ang may batas laban sa desaparecidos sa buong Asya.
Nakasaad sa batas na “a crime of enforced disappearance is considered committed if 1) a victim is deprived of liberty; 2) the perpetrator is the State or agents of the State; and 3) information on the whereabouts of the victim is concealed or denied.”
Para kay Palabay, walang mabuting maidulot sa mga mamamayan ang NTF-ELCAC at tinawag ang mga opisyal at miyembro nito bilang “professional liars.”
Ayon sa RA 10353, papatawan ng “life sentence equivalent to 20 years and one day to 40 years imprisonment” ang mga napatunayang guilty sa enforced disappearance case.
Kaugnay nito, nakabibingi ang katahimikan ni Pangulong Ferdinand “Bongbong” Marcos Jr. sa rebelasyong dinukot ng militar ang dalawang environmental activists.
Sa kanyang paskil sa Facebook, sinabi ni Bagong Alyansang Makabayan (Bayan) President Renato Reyes Jr., dapat ay paimbestigahan ni Marcos Jr, pagsiwalat ng dalawang babaeng aktibista sa sinapit nila sa kamay ng militar
“To Mr. Marcos Jr in light of the revelations of the 2 environmental activists:
Will you not call for an impartial investigation into the abduction of 2 environmental activists and the apparent cover up done by the military? Isn’t the testimony of the 2, aired at great risk to their lives while under military custody, enough to warrant a full-blown investigation?” ani Reyes.
Tanong niya, “Shouldn’t you fire all the officials engaged in the elaborate cover up? Shouldn’t you finally abolish the NTF- ELCAC?”
Hindi ba aniya dapat ay maglabas ng kalatas si Marcos Jr. na ang mga pagdukot at puwersahang pagsuko ay hindi katanggap-tanggap dahil ito’y paglabag sa karapatang pantao.
“Shouldn’t you issue an unequivocal statement that abductions and forced surrenders are not acceptable because they are human rights violations? Why the deafening silence when it comes to human rights? Is it 1972 all over again?”
Hindi aniya dapat suspendihin ang karapatan laban sa “enforced or involuntary disappearance” gayundin ang batayang mga pananggalang at pag-iwas rito sa kahit anong pagkakatao kabilang ang “political instability, threat of war, state of war or other public emergencies.”
“The right against enforced or involuntary disappearance and the fundamental safeguards for its prevention shall not be suspended under any circumstance including political instability, threat of war, state of war or other public emergencies.”
