Inihain nina Senator Koko Pimentel, Neri Colmenares, Carlos Zarate at Ferdinand Gaite ang isang petisyon para ideklara ng Korte Suprema ang Maharlika Investment Fund Act of 2003 (MIF) na labag sa 1987 Constitution.
Ang MIF Act o Republic Act No. 11954 ay nilagdaan bilang batas ni Pangulong Ferdinand “Bongbong” Marcos Jr. noong 18 Hulyo na pamamahalaan ng Maharlika Investment Corporation (MIC) na may seed capital na P150 bilyon.
Sa kanilang petisyon ay hiniling nila sa Korte Suprema na maglabas ng temporary restraining order (TRO) o preliminary injunction o status quo ante order (SQAO) para itigil agad ang pagpapatupad ng RA 11954, at magsagawa ng oral arguments.
Ang mga pinangalanang respondent sa petisyon ay sina Executive Secretary Lucas P. Bersamin, Finance Secretary Benjamin E. Diokno, House of Representatives, at ang Senado.
Tatlong “serious grounds” ang binanggit sa petition na humihirit na idekalarang labag sa Saligang Batas ang MIF Act, gaya ng: “RA 11954 is void because it was passed in violation of Section 26 (2), Article VI, of the 1987 Constitution; the test of economic viability as mandated under Section 16, Article XII of the Constitution was not complied with prior to the creation of the Maharlika Investment Corporation; and RA 11954 violates the independence of the Bangko Sentral ng Pilipinas as provided for under Section 20, Article XII of the Constitution.”
Nakasaad sa petisyon na ang MIF Act ay paglabag umano sa Seksyon 26 (2), Artikulo VI ng Konstitusyon, na “ang Presidential certification ng Maharlika Bill sa House of Representatives at Senado ay hindi sumunod sa constitutional requirement” at dahil ang panukalang batas ay hindi naisabatas. alinsunod sa Konstitusyon, ito ay “samakatuwid ay hindi naging batas.”
Iginiit sa petisyon“the Maharlika Investment Fund Act of 2023 therefore requires intense congressional scrutiny, genuine consultation with stakeholders, and a careful study by independent economic experts.”
Anito, “both Houses of Congress, however, went on the opposite direction and rushed the Maharlika bills and short-circuited the constitutionally mandated legislative processes, through an unnecessary and constitutionally infirm Presidential certification of urgency.”
